The analysis "Position of Judges, Overview of Legislative Framework and Practice" refers to the status of judges, their appointment, career development, functional immunity and termination of judicial office, with special focus on Rulebook on Performance Evaluation of Judges.
The analysis addressed international and European standards in this field, CEPEJ findings and opinions of the Venice Commission on these issues, compliance of these standards and guidelines with national legal framework, as well as the practice of the competent authorities. This analysis is conducted in the context that implies future changes in the legal framework of Serbia in the field of justice, and offered an important insight into the important issues related to the harmonization of existing legislative solutions with the international, especially European standards.
The best comparative practice in the European Union in the relevant field was analyzed and consultation with relevant domestic experts in this field, aiming to evaluate compliance with the standards of efficiency, consistency and integrity.
Along with analysis of the international and domestic legislative framework, recommendations for amendments of relevant regulations have been drafted, taking into account CEPEJ standards and other relevant international standards.
